In responding to these unconstitutional events, however, all actions by the Turkish authorities must not exceed the legal framework of the Turkish Constitution and Turkey's international human right commitments,” said Director Link. “In investigating these events and holding responsible those who have attempted the coup, the authorities must ensure that human rights standards, due process, fair trial rights and respect for the independence of the judiciary are respected. Talk by authorities of a possible reintroduction of the death penalty and the summary firing of thousands of judges are clearly crossing the line of existing legal standards." rule Canada Passes New Right To Repair Rules With the Same Old Problem By news.slashdot.org Published On :: 2024-11-13T13:00:00+00:00 An anonymous reader quotes a report from The Register: Royal assent was granted to two right to repair bills last week that amend Canada's Copyright Act to allow the circumvention of technological protection measures (TPMs) if this is done for the purposes of "maintaining or repairing a product, including any related diagnosing," and "to make the program or a device in which it is embedded interoperable with any other computer program, device or component." The pair of bills allow device owners to not only repair their own stuff regardless of how a program is written to prevent such non-OEM measures, but said owners can also make their devices work with third-party components without needing to go through the manufacturer to do so. Bills C-244 (repairability) and C-294 (interoperability) go a long way toward advancing the right to repair in Canada and, as iFixit pointed out, are the first federal laws anywhere that address how TPMs restrict the right to repair -- but they're hardly final. TPMs can take a number of forms, from simple administrative passwords to encryption, registration keys, or even the need for a physical object like a USB dongle to unlock access to copyrighted components of a device's software. Most commercially manufactured devices with proprietary embedded software include some form of TPM, and neither C-244 nor C-294 place any restrictions on the use of such measures by manufacturers. As iFixit points out, neither Copyright Act amendments do anything to expand access to the tools needed to circumvent TPMs. That puts Canadians in a similar position to US repair advocates, who in 2021 saw the US Copyright Office loosen DMCA restrictions to allow limited repairs of some devices despite TPMs, but without allowing access to the tools needed to do so. Thursday, July 26, 2012 The High Court has today granted permission to two disabled people to bring a claim forjudicial review against the Secretary of State for Work and Pensions to challenge theoperation of the Work Capability Assessment (WCA).WCAs are face to face interviews carried out by healthcare professionals (HCPs)employed by Atos Healthcare (a private contractor), to assess disabled people’sentitlement to Employment and Support Allowance (a sickness benefit that has replacedthe old Incapacity Benefit). Each existing recipient of Incapacity Benefit is now beingassessed for eligibility for ESA, at the rate of some 11,000 people per week. WCAs havebeen the subject of serious criticism by all relevant stakeholders in civil society includingdoctors and NGOs working on behalf of disabled people.The present case concerns some of the problems with the system as experienced bypeople with mental health problems. Although medically trained, Atos HCPs typicallyhave very limited knowledge of mental health. The interviews are often hurried, and relyon applicants to explain the limitations on their ability to work.This is a serious problem for people with mental health conditions who lack insight intotheir conditions, whose conditions fluctuate in seriousness, or who cannot easily talkabout their disability. Such people are placed at a substantial disadvantage in navigatingthe system. Even if they appreciate the need to get expert medical evidence forthemselves, they are often less able to navigate the system successfully and to obtainthe medical report that they need. The Equality Act 2010 requires the DWP to makereasonable adjustments to avoid such disadvantage.The reasonable adjustment to the process that the claimants seek is for medicalevidence to be sought by the Atos HCP and the DWP at the very outset of the claim.This would ensure that very sick people for whom having to go through a WCA would beextremely distressing are exempted from the process, and for those that do attend aWCA, the assessment of fitness to work takes place in the correct medical context, sothat dangers associated with forcing people back to work are correctly identified.At present, the DWP do not routinely ask for expert medical report from an applicant’scommunity-based doctor. The judge has held that it is arguable that this failure is abreach of the duty to make reasonable adjustments, and is therefore unlawful.In granting permission to apply for judicial review, the judge stated:“I consider that it is reasonably arguable that the reasonable adjustmentsrequired by the [Equality Act 2010] include the early obtaining of independentmedical evidence where the documents submitted with the claim show that theclaimant suffers from mental health problems and that this has not been done, orat least not done on a sufficiently widespread basis”.The claimants, known as MM and DM, were granted anonymity by the court.
