These two appeals against the decision of the Customs Excise & Service Tax Appellate Tribunal (CESTAT) rendered on 16th July, 2008 require adjudication on the question as to whether 1 “car matting” would come within Chapter 57 of the First Schedule to the Central Excise Tariff Act, 1985 under the heading “Carpets and Other Textile Floor Coverings” or they would be classified under Chapter 87 thereof, which relates to “Vehicles other than Railway or Tramway Rolling-Stock and Parts and Accessories Thereof”. The appeals are against a common decision and we shall also deal with both these appeals together in this judgment. The respondent-assessee want their goods to be placed under Chapter heading 5703.90. We shall refer to the specific entries against this item later in the judgment. The respondent, at the material point of time were engaged in the business of manufacture of textile floor coverings and car matting. The subject-goods have been referred to interchangeably by the revenue also as car mattings and car carpets. The respondent, at the material time, were clearing the goods declaring them to be goods against Heading No.570390.90. Effective rate of excise duty on goods under that entry was 8% and education cess at the applicable rate for the subject period. We find this rate of duty, 2 inter-alia, from the order of the Commissioner dealing with the first and the second show-cause notices. The rate of basic excise duty would have been 16% apart from education cess if these goods were classified against goods specified in heading no.8708.99.00. Altogether three show-cause-notices were issued against the respondent over clearance of goods under the said heading. These notices required them to answer as to why they should not be charged the differential rate of duty and interest. We would like to point out here that in the show-cause notices, the respective chapter sub-headings have been referred to as 8708.99.00 and 570390.90 and in the order of the Tribunal also, the sub-headings have been referred to as such. But the authorities themselves in certain places described the sub-headings in shorter numerical forms, as 5703.90 and 8708.00. We find these minor variations in the paper-book. But this variation of the sub- headings represented in numerical form is not of any significance so far as adjudication of these appeals are concerned. The respondent were also to answer as to why penalty should not be 3 imposed upon them in terms of Section 38A of the Central Excise Act, 1944 read with Rule 25 of the Rules made thereunder. The first show-cause notice is dated 9th August, 2005 in regard to clearance of goods made during the period between 9 th July, 2004 and 31st March, 2005. They had cleared altogether 8,65,777 pieces of those items in different sizes in that period. The second show-cause notice was issued on 2 nd May, 2006 and related to clearance of 12,02,482 pieces of the same goods for the period between 1st April, 2005 and 31st January, 2006. The third show- cause notice is of 7th March, 2007 and the clearance involved 20,15,412 pieces from 1st February, 2006 to 31st January, 2007. For the period involved in the third show-cause notice, clearance was made by the respondent under Chapter sub-heading no.570500.19, which carried effective rate of duty @8%.

School outbreak investigation in Quebec, Canada suggested that adolescents previously vaccinated with 2 doses of measles vaccine beginning at 12 months of age were at greater measles risk than those whose first dose was given at ≥15 months of age.

Mumbai Metro Rail Corporation (MMRC) on Thursday achieved yet another milestone with its 28th breakthrough from Chhatrapati Shivaji Maharaj Terminus to Mumbai Central. Vaitarna-2 is the first TBM to complete the stretch of 4km in a single drive.

Vaitarna-2, the Tunnel Boring Machine (TBM) of this package was commissioned on February 2, from CSMT launching shaft and completed its longest run at Mumbai Central station with 2,730 RCC rings.

"This part of the tunneling was very challenging particularly because the alignment runs very close to old and dilapidated buildings and also parallel to the sea shore and very shallow ground water table which is approximately 1-4 meters below only", said Ranjit Singh Deol, Managing Director, MMRC.

"Another challenge posed before the team was the outbreak of COVID-19. However, we ensured physical distancing and strictly followed all the guidelines stipulated by the state government”, said Deol further.

The 4-km long tunneling, on the Colaba-Bandra-SEEPZ Metro-3 Corridor, includes the construction of five underground stations beginning from Chatrapati Shivaji Maharaj Terminus to Mumbai Central via Kalbadevi, Girgaon and Grant Road.

While the BMC has issued an order for 100 per cent attendance of its employees, municipal corporations in the Mumbai Metropolitan Region (MMR) want its residents to stay away from the city. The corporations are working on a plan to restrict the transmission of COVID-19 through residents who regularly go to Mumbai for essential services.

The plan is still in a primary mode but the corporations are likely ask service providers to make accommodation available for its employees near their respective work areas.

MMR, which includes Thane, Thane rural, Navi Mumbai, Kalyan-Dombivali, Ulhasnagar, Bhiwandi-Nizampur, Mira-Bhayandar, Palghar, Vasai-Virar, and Panvel Corporation, collectively has 1,159 patients, way below that in Mumbai which has close to 7,000.

"Nearly one lakh people travel to Mumbai from MMR every day for their jobs under essential services like banks, hospitals, and BMC. So if these areas maintain minimum contact with Mumbai, the transmission of COVID in MMR will be low," said a bureaucrat from the region.

"The number of positive patients in our area has gone up because of some residents who work at a private hospital in Mumbai. We are going to ask private hospitals to arrange for stay facilities for them," said a commissioner of one of these corporations. The civic body has identified 36 employees who work with the hospital.

The ideal situation is to create accommodation facilities for the employees near the work area. The chances of transmission increase due to travel. We are speaking to BMC," said a civic officer from MMR. Alternatively, he said, respective corporations could prepare Care Centres outside their residential areas for these employees who visit Mumbai daily. The administration is also thinking of a 15-day work, 15-day off policy for these employees.

While the MMR region comes under the red zone, some activities can start here if the number of patients go down. A list of migrants in each district – Thane, Palghar and Raigad — is also being prepared so they can go to their states safely.

Maharashtra government's offices located in Mumbai Metropolitan Region (MMR), in areas of municipal corporations of Pune, Pimpri-Chinchwad and Malegaon in Nashik district will function with five per cent attendance during the lockdown period till May 17 to contain spread of coronavirus. The MMR and areas under PMC, PCMC and Malegaon Municipal Corporation (MMC) have emerged as the coronavirus hotspots. In a statement on Tuesday, the government also said that in the rest of Maharashtra, the attendance of officials of the rank of deputy secretary and above will be 100 per cent, while that of the other officials and staffers will be 33 per cent as per the requirement.

The government, however, said that offices of departments such as health and family welfare, police, jail, fire brigade and emergency services, disaster management, Food Corporation of India, Nehru Yuva Kendra, municipal services and others will remain functional with complete attendance. The statement also said that the government officials and staffers should download the 'Aarogya Setu' application on their smartphones and work according to the guidelines issued by the Centre.

The statement reiterated that those attending offices should take precautionary measures and maintain proper hygiene during the period to keep the novel coronavirus at bay.

Trains ferrying migrant workers have been on the move with about 14 of them having left from the Central Railway section and 62 from the Western Railway section across different divisions. However, there continues to be limitations in the number of trains leaving from the Mumbai Metropolitan Region (MMR) as it is a red zone.

So far, eight trains have left from the MMR region with a couple of more planned in the coming days. A Bhivandi Road-Gorakhpur one was the first train to leave the MMR region on May 2 with 1,104 migrants.

The same day another train left from Vasai Road for Gorakhpur with 1,200 migrants. After this, two trains left for Jaipur — one from Bhivandi and another from Dahanu — on May 4, two from Kalyan to Darbhanga and Kalyan to Guntkul on May 5 and another two — Panvel to Rewa and Bhivandi to Patna in the wee hours of May 6.

Meanwhile, the first train to arrive in Maharashtra was from Rayanapadu in Vijaywada. It reached Chandrapur with 1,212 migrants around 9.10 am on May 6. The passengers were provided with food and water by the state government and later taken for health check-ups by the district collector before being sent to their homes.

One of the group leaders, who was onboard the train, said the migrants from Maharashtra had gone to Rayanapadu for red chilli plucking and transport was organised by the Krishna district administration. "They were taken to the station in 48 buses with 25 passengers each. The passengers included senior citizens, women and children too," he told mid-day over phone. Western Railway chief PRO, Ravinder Bhakar said the railways would run these trains as long as there was demand from other state governments.
