This Amendment adds the Sussex County Association of Towns to the Delaware Population Consortium and correspondingly revises the quorum requirement.

To prevent the Division of Waste and Hazardous Substances’ permit activities from being considered littering, this Amendment makes changes to the provision under which littering is unlawful, by clarifying that either of the following 2 situations are lawful: The property is designated for litter management and the person was authorized to use the property for that purpose. - or - The litter is placed in a litter receptacle or container installed at the property. - and – The person is the owner or tenant in lawful possession of the property or first obtained the owner’s consent, or the act is done under the personal direction of the owner or tenant, all in a manner consistent with the public welfare. This Amendment also makes a technical correction.

This Amendment requires the following: (1) That an owner of a motorcycle who is enrolled in an experienced rider course at the time of application for a motorcycle club’s special registration plate must provide verification of completion of the course to the motorcycle club. (2) That the Division of Motor Vehicle shall revoke a special registration plate if a motorcycle club notifies the Division that an owner has not completed the experienced rider course. (3) That a motorcycle club have 25 applicants for its special registration plate before the Division may issue the special registration plate. This Amendment also creates a nonexclusive list of motorcycle clubs for which the Division could issue a special registration plate. This Amendment also makes a technical correction to line 36 to ensure consistent use of “special registration plate”.

This Amendment corrects a typographical error and allows money deposited in the Prescription Opioid Impact Fund to be used to support peer support programs.

This Amendment does the following: (1) Makes an individual ineligible for an expungement of a felony offense if the individual has previously had a felony conviction expunged. (2) Makes two misdemeanor offenses eligible for expungement only through the the discretionary process, regardless as to whether the offenses are a misdemeanor crime of domestic violence (Sexual Harassment, under § 763 of Title 11, and Indecent Exposure in the First Degree, under § 765 of Title 11). (3) Removes two misdemeanor offenses from the definition of misdemeanor crime of domestic violence because they are not subject to mandatory expungement under other provisions of this Act (Incest, under § 766 of Title 11, and Unlawful Sexual Contact in the Third Degree, under § 767 of Title 11) and adds one misdemeanor offense to the definition (Harassment, under § 1311 of Title 11). (4) Makes additional misdemeanor offenses eligible for expungement only through the discretionary expungement process. (5) Moves the Attorney General’s responsibilities for notifying a victim of a discretionary expungement petition to the discretionary expungement provision.

This Amendment makes the following changes to Senate Bill No. 32: 1. Identifies additional kinds of payments that are not prohibited. 2. Uses enforcement language that is consistent with other chapters in Title 6. 3. Clarifies that this Act does not modify any requirements under State or federal mental health parity laws.

This Amendment does the following: (1) Exempts controlled substances listed on Schedule II and IV from medications that can be administered by a direct care worker under this Act. (2) Clarifies the packaging instructions and increases the information that must be on each medication the direct care worker is to administer. (3) Requires that before administering medication under this Act, a direct care worker must complete a training program on the administration of medications that is approved by the Secretary of the Department of Health and Social Services (“Department”). (4) Requires that a direct care worker provide the documentation the worker keeps regarding administered medications to the personal assistance services agency that employs the worker and that the agency retains the documentation and makes it available to the Secretary of the Department of Health and Social Services on request. (5) Delays the implementation of this Act until the earlier of 1 year from the date of the Act’s enactment or the promulgation of final regulations to implement this Act by the Secretary and the publication of notice in the Register of Regulations that regulations required to implement this Act have been promulgated.

This Amendment does the following: (1) Adds a three-fifths vote requirement because the Act grants the Secretary of State the authority to set fees to defray the expenses related to the administration of this chapter. (2) Changes language related to what the Secretary provides an athlete agent as proof the agent is properly registered to reflect the Secretary's practice of providing electronic records in lieu of paper documents to licensed professionals through the Division of Professional Regulation. (3) Removes language that is subject to a possible amendment to the Uniform Act to be considered by the Uniform Law Commission.

This Amendment revises the language in the notice provided to patients and sunsets this Act in 3 years, unless extended by the General Assembly.

This Amendment adds language to make clear that "person" applies to the owner, lessee, proprietor, manager, director, supervisor, superintendent, agent, or employee of any place of public accommodation. This change is consistent with similar existing law provisions in the Act.

This Amendment makes technical corrections to the Act to correct drafting errors.

This Amendment reduces the number of Board-appointed members to three and adds the City Manager of Delaware City as a Board member.

This Amendment does the following: (1) Removes an existing defined term that is made unnecessary by changes made by the Act. (2) Restores the aggravators for resisting arrest by and fleeing from a law enforcement officer. (3) Makes clear that a defendant may be charged with the crime of resisting arrest or the aggravator for resisting, but not both. (4) Makes clear the aggravator for a protected school zone applies when the conduct occurs in a protected school zone, but not when a pursuit of a suspect ends in the protected school zone. (5) Replaces references to “protected school zone” in offenses enhanced by the protected school zone with references to “aggravating factor”.

This amendment eliminates an unnecessary requirement of a paper report and requires instead that the report be published electronically.

This amendment makes a technical change to the Bill.

This amendment deletes a provision relating to the liability of a fiduciary when acting at the direction of an advisor. The amendment also deletes a provision relating to the ability of parties to release a fiduciary from liability for various actions associated with the fiduciary's use of an agent. In addition, this amendment deletes a provision changing the time at which a statute of limitations provision begins to run.

This Amendment makes a technical correction to a Delaware Code citation.

This Amendment makes a technical correction to make clear that the Department must use different election districts for each of the post-election audits required under the Act.

This Amendment adds New York to the list of states required to enact a law similar to this Act before this Act takes effect.

When defendants are late paying their fines, the courts’ clerks must forward the defendant’s name to the Department of Transportation’s Division of Motor Vehicles for license suspension. This Amendment prohibits a court or the Department of Transportation from suspending a driver’s license for nonpayment of a fine, fee, cost, or assessment and from charging a penalty, assessment, or fee to a defendant for the cancellation of a warrant issued due to the defendant’s nonpayment of a fine, fee, cost, or assessment.

This Amendment clarifies the legal effect of the transfer of the Office of Child Care Licensing from the Department of Services for Children, Youth and Their Families to the Department Education. This Amendment also creates a requirement that the Secretary of the Department Education and the Secretary of the Department of Services for Children, Youth and Their Families develop a transition plan for the transfer.

This amendment adds a 3 year sunset provision to the reallocation of technology, personnel, and equipment from Executive Branch agencies.

This Amendment specifies that Seasonal Patrol Officers are not authorized to enforce a limited category of class D environmental regulations concerning the act of sport fishing. It also provides the Director of the Division of Parks and Recreation with the authority to establish policies that limit or define the duties and enforcement powers of Seasonal Patrol Officers, as the Director may deem appropriate within the rules and regulations of the Division.

This Amendment makes a technical correction to allow the Department of Transportation to release certain information when used to create reports.

This amendment prohibits the County from entering into an exclusive agreement relating to wireless communication leases for New Castle County park areas and open space.

This amendment makes a technical correction to the bill and removes the Sunset provision.

This amendment adds an exception which allows a dog to be outside if engaged in the protection of farm property. The bill already provides such an exception for dogs engaged in the protection of livestock and poultry.

This Amendment revises the correction to § 122 of Title 16 to retain more of the current detail regarding required services at freestanding emergency departments.

This Amendment clarifies that the penalties apply when an employer knowingly fails to comply with a notice to garnish wages.

This amendment makes technical changes to the Bill. It clarifies who shall be members of the Consortium and how the co-chairs are appointed. Finally, it requires that the Consortium submit reports to the City of Wilmington.

This Amendment adds representatives from the minority caucus of each Chamber to the Consortium.

This Amendment makes a technical correction and clarifies the qualifications of the members who are appointed by the Governor.

This Amendment returns an expiration date for the HSCA Fund tax assessment and extends the date to January 1, 2029.

This Amendment corrects 2 technical errors. The first is a typographical error. The second removes reference to Career Compass as a publication of the Delaware Advisory Council on Career and Technical Education ("DACCTE"), which is published by the Department of Labor. Also, although a synopsis cannot be amended, it is worth noting that the synopsis for Senate Bill No. 138 incorrectly references term limits for the DACCTE chair. Under SB 138, the chair serves at the pleasure of the Governor.

This Amendment allows persons who have been adjudicated delinquent of a crime as a juvenile to be eligible for Probation Before Judgement under the provisions of this section.

This amendment makes a previous section of the Delaware Code consistent with the intent of the Bill.

This Amendment adds the Executive Director of the Delaware Food Industry Council to the stakeholder panel.

This Amendment lowers the penalty for possessing a drug masking product from a class A misdemeanor to a class B misdemeanor.

This Amendment makes the possession or private use or consumption of a personal use quantity of marijuana a civil offense for an individual who is under 21 years of age only for the first and second offense. A third offense would be an unclassified misdemeanor.

This Amendment does the following: 1. Provides that the Delaware Volunteer Fire Association participate in defining tobacco use that excludes a covered firefighter from the presumption of eligibility under this Act. 2. Provides that the State Fire Prevention Commission, Department of Human Resources, and the Delaware Volunteer Fire Association must establish the requirements for medical examinations under this Act. 3. Clarifies that the definition of "occupational disease" applies only to this Act and not to Worker's Compensation. 4. Makes this Act effective January 1, 2020, or when the requirements under § 6709(d)(2)b. of Title 18 are established, whichever is earlier.

This Amendment does the following: (1) Strikes House Amendment No. 1 to House Bill No. 114, reverting the waiting periods for public access to individual vital records to the periods provided in House Bill No. 114 and then amends House Bill No. 114 to further revert the waiting periods for birth and death records to 72 and 40 years, respectively, and to increase the waiting period for marriage records from 40 years to 50 years. (2) Amends House Bill No. 114 to include the Delaware Code section heading for § 209 of Title 13 to add clarity. (3) Requires the county clerks of the peace and the Office of Vital Statistics to prepare and submit a report to President Pro Tempore of the Senate and the Speaker of the House of Representatives, with copies to all members of the General Assembly and the Librarian of the Division of Research of Legislative Council, no later than March 1, 2020, on the feasibility of increasing the waiting periods related to the full disclosure of birth, death, and marriage records.
